5.2 Payment Processing Fees
Third-party payment processors charge fees for certain payment methods. Current fees are disclosed on our website and at the time of payment. These fees are set by the payment processor, not Covey Financial, and we receive no portion of these fees.
5.3 Payment Processing and Timing
- Payments submitted online cannot be stopped, reversed, or returned once processed
- Payment processing may take several business days
- You are responsible for ensuring sufficient funds in your account
- We reserve the right to reject or return payments at our discretion
5.4 Returned Payment Fee
A $25 fee will be charged for payments returned due to insufficient funds, closed accounts, or other reasons.

If your loan includes an escrow account, we will:
- Collect monthly escrow payments as part of your mortgage payment
- Pay property taxes and insurance premiums on your behalf when due
- Provide annual escrow account statements
- Conduct annual escrow analyses and adjust payments as necessary
You are responsible for:
- Providing current tax and insurance information
- Maintaining adequate insurance coverage
- Reviewing escrow statements for accuracy

Your Rights as a Borrower
1. Your Rights Under the Real Estate Settlement Procedures Act (RESPA)

2.3 Our Response Timeline

3. Reporting Errors on Your Account
3.1 What is a Notice of Error (NOE)?
If you believe there is an error with your mortgage account, you have the right to submit a Notice of Error. Errors may include:
- Payments not credited to your account
- Incorrect payment amount, interest rate, or principal balance
- Incorrect escrow calculations or payments
- Improper fees or charges
- Failure to provide accurate payoff amounts
- Failure to provide accurate information in response to a previous inquiry
- Incorrect credit reporting information
- Any other error related to the servicing of your loan

3.3 Our Response Timeline

4. Protection from Improper Practices
4.1 Force-Placed Insurance
We may only charge you for force-placed insurance if:
- Your insurance has lapsed or is insufficient
- We have sent you the required notices
- You have not provided proof of adequate insurance
If you obtain adequate insurance, we must cancel the force-placed insurance and refund any premiums paid for overlapping coverage.
4.2 Prompt Payment Crediting
We must credit your payment to your account as of the date we receive it, as long as:
- The payment includes sufficient information to credit the account
- The payment is in a form we accept
- The payment is received at the correct address
4.3 Partial Payment Policy
If you make a partial payment (less than the full amount due), we may:
- Hold the payment in a suspense account until you pay the remainder
- Return the payment to you
- Accept the payment and apply it to your account
We will inform you of our partial payment policy upon request.
5. Protections Related to Loss Mitigation
5.1 Loss Mitigation Applications
If you are having difficulty making your mortgage payments, you may apply for loss mitigation assistance (such as loan modification, forbearance, or repayment plans).
We will notify you within 5 business days if your application is complete or if we need additional information.
5.2 Dual Tracking Prohibition
If you have submitted a complete loss mitigation application, we generally cannot:
- Make the first notice or filing required for foreclosure
- Move forward with a foreclosure sale
There are certain exceptions to this rule, which we will explain if applicable.
5.3 Appeal Rights
If your loss mitigation application is denied, you have the right to appeal the decision within 14 days of receiving the denial notice.
6. Servicing Transfer Protections
If your loan is transferred to a new servicer:
- You will receive notice at least 15 days before the transfer date
- Your current servicer must send you a goodbye notice
- Your new servicer must send you a hello notice
- You have a 60-day grace period during which you cannot be charged late fees if you send your payment to the old servicer by mistake
7. Annual Escrow Statements
If you have an escrow account, you will receive an annual statement showing:
- All deposits into and payments from your escrow account
- The projected activity for the coming year
- Any escrow shortage or surplus
- Changes to your monthly payment amount
8. Periodic Billing Statements
You will receive a billing statement for each billing cycle (generally monthly) that shows:
- Amount due and due date
- Explanation of the amount due
- Transaction activity since the last statement
- Fees charged (if any)
- Contact information for assistance
9. Payoff Statements
You have the right to request a payoff statement, which will show the amount required to pay off your loan in full. We will provide this information within 7 business days of your request.
